At FlowNex AI we protect your data with seriousness and transparency. Here we explain what information we collect, for what purpose, and how you can exercise your rights.

1. Introduction

This Privacy Policy describes how FlowNex AI SpA (“we,” “our,” “us”) collects, uses, and protects the personal information of users (“you,” “your”) when you interact with our forms, applications, and services (including our products Agentia and Agentia Assistant) on our websites and digital platforms, such as WhatsApp and Google authentication solutions.

2. Services and Scope

  • Agentia (customer service and automations): integrates channels like WhatsApp Business Cloud and Webchat to handle inquiries, sales, appointment booking, and order tracking. It processes chat content, messaging metadata (e.g., timestamp, delivery status), phone number, and user contact preferences to provide and improve the service.
  • Agentia Assistant (business management): enables you to query, gather, and analyze data from company areas connected by the client (e.g., CRM/ERP/e-commerce) via natural language. It only accesses connected sources and the minimum data required to answer each request.
  • Sign-in with Google (GCP/OAuth): when you use “Continue with Google,” we obtain only the data necessary for authentication and identification (e.g.,openid, email, profile) according to your consent settings.

3. Information We Collect

  • Contact data: name, email address, phone number, role, and company.
  • Interaction data: message content, attachments you send, communication preferences, conversation history, and technical metadata (e.g., timestamp and message status).
  • Authentication data (Google): identifiers and basic attributes per the authorized scopes (e.g., email and name). We do not access Google product information beyond what you explicitly consent to.
  • Business data: order details, appointments, tickets, or inquiries when client systems (CRM/ERP/e-commerce) are connected.
  • Any other information you voluntarily provide through our forms or channels.

4. Purposes of Processing

  • To provide and improve our services (support, automation, analytics, and reporting).
  • To respond to requests, provide support, and manage commercial relationships.
  • Marketing and communications: to send content, offers, newsletters, and promotional messages through permitted channels (including WhatsApp) to users with a valid opt-in. You can unsubscribe at any time (see section 9).
  • Security, fraud prevention, and legal compliance.

5. Legal Basis

  • Your consent (e.g., forms and opt-in for WhatsApp/marketing).
  • Legitimate interest in offering and improving our services.
  • Contract performance when a commercial relationship exists.
  • Legal compliance when applicable.

6. Platform-Specific Rules

6.1 WhatsApp Business Cloud

  • Required opt-in: we only send proactive messages (e.g., templates/marketing) to users who granted prior, verifiable permission. We honor opt-out at any time.
  • Processing and security: WhatsApp messages are end-to-end encrypted until delivered to the recipient; the Cloud API service is hosted by Meta. We implement measures to maintain confidentiality of messaging data.
  • Permitted content: we comply with WhatsApp’s messaging and commerce policies, including quality requirements, relevance, and topic limitations.

6.2 Sign-in with Google (GCP/OAuth)

  • Minimal scopes: we request openid, email, and/orprofile for authentication and identification.
  • Limited use: Google data is used only for user-visible functions related to the service (e.g., sign-in). We do not sell it or use it for ads, and we do not allow human access except with explicit consent or to meet security/legal obligations.
  • Verification: we maintain verified domains and a policy published and accessible from the Google consent screen.

7. Data Sharing with Third Parties

We do not sell your data. We may share it with processors (service providers) who perform services under contract and strict confidentiality, such as: infrastructure and hosting, messaging (including the Meta-hosted WhatsApp Cloud platform), authentication (Google), operational analytics, email delivery, and secure storage. We may also share data where required by law or to protect rights and safety.

8. International Transfers

Our providers may operate in different countries. We implement appropriate contractual and technical measures to protect your data in accordance with applicable law (e.g., Standard Contractual Clauses where appropriate).

9. Your Rights, Consent, and Opt-Out

  • Access, rectify, delete, or restrict processing of your data.
  • Withdraw your consent and object to direct marketing at any time.
  • To stop receiving WhatsApp or other channel messages, use the unsubscribe options indicated in each channel (e.g., reply “STOP/UNSUBSCRIBE”) or contact us.

10. Security

We apply reasonable technical and organizational measures (encryption in transit, access controls, activity logging, security testing, and minimization policies) to protect your information against unauthorized access, alteration, or loss.

11. Data Retention

We retain data for as long as necessary to fulfill the purposes described (service delivery, legal obligations, and defense of rights) or until you request deletion where applicable.

12. Data Deletion

  • General request: you can request deletion of your data at https://flownexai.com/privacy/eliminar-datos. We will indicate the status and time frame for deletion.
  • Meta (including WhatsApp): in addition to the page above, our app exposes a Data Deletion Callback for requests initiated from Meta’s ecosystem in accordance with platform policies.

13. Changes to This Policy

We may update this policy to reflect legal, technical, or business changes. We will publish the current version on our site and, where appropriate, notify you of material changes.
